A Quick Guide to Co-Counseling

Over the years we’ve had the privilege of co-counseling and assisting many attorneys on a variety of personal injury cases. It’s how we’ve been able to successfully structure this firm. However, many of the attorneys we’ve encountered in that time (including those we ended up working with) seemed to share a similar trepidation towards co-counseling and the co-counseling process.

So, to help alleviate those concerns, we’ve created a quick guide to co-counseling.

WHAT IS CO-COUNSELING?

Co-counseling describes the process when an attorney assists or shares the responsibility of representing a client.

Typically, co-counseling happens as a result of one attorney practicing or possessing expertise in a particular disciple of law the client’s attorney does not.

HOW DOES CO-COUNSELING WORK?

Say, for example, the longtime client of an estate planning attorney becomes the victim of medical malpractice.

Despite the client trusting the estate planning attorney implicitly to handle the case, the estate planning attorney doesn’t feel comfortable doing so due to their lack of experience and expertise in the medical malpractice area. So, they may seek out an attorney that does and enter into a co-counsel agreement.

And in doing so, not only will the estate planning attorney get to collect a co-counsel fee, but they’ll remain part of the case and build more trust with their client as a result.
